2. Acceptance of conditions

The Customer acknowledges having read, at the time of placing the order, these GTC and expressly declares to accept them without reservation. These GTC prevail over any other general or specific conditions not expressly agreed upon by the Seller.

3. Products and prices

The products offered for sale are those appearing on the Seller’s website. Prices are indicated in euros and are subject to change without notice. The price applicable is the one in effect at the time of the order validation by the Customer.

4. Orders

The Customer places an order online via the Seller’s website. The order is definitively confirmed when payment is accepted by the Seller’s banking services. The software license will be generated based on the client’s unique system identifier (UUID). The Seller reserves the right to refuse any order for legitimate reasons, particularly in case of payment problems, fraud, or violation of these GTC.

5. Delivery

The software license is typically delivered within 48 hours following order confirmation and receipt of payment. It is transmitted electronically, in the form of a digital key associated with the customer’s unique system identifier (UUID). The Customer is responsible for ensuring that their contact information is correct to receive the software license.

6. Software activation

By placing an order and receiving the digital key to activate the software, the Customer acknowledges and accepts that this action constitutes an act of software activation. Therefore, pursuant to Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised once the software has been activated.

7. Access to the demo version

The Customer is informed that a demo version of the software is available for evaluation before purchasing the license. The Customer is responsible for testing this demo version to determine if the software meets their needs and expectations. Without technical support guarantees post-purchase, the Customer is encouraged to use the demo version for any preliminary evaluation.

8. Intellectual property

The Customer acknowledges that the software license remains the intellectual property of the Seller and agrees not to copy it, reproduce, distribute, or resell it without prior authorization.

9. Sectoral Restriction

The sale of licenses is prohibited to any company or organization whose main or substantial activity involves the design, manufacture, or sale of weapons, weapon systems, or components intended for military use. By proceeding with the purchase, the Buyer declares that they are not engaged in such sectors.

10. Liability

The Seller shall not be liable for direct or indirect damages resulting from the use or inability to use the software license, except in cases of intentional misconduct or gross negligence on its part.

11. Personal data

The Customer consents to the data collected concerning them during the order being used by the Seller for order management and commercial relationship purposes. The Customer has a right of access, rectification, and deletion of their personal data, which they can exercise by contacting the Seller.

12. Applicable law and disputes

These GTC are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing that, the French courts shall have sole jurisdiction to settle the dispute. The Customer is informed of the existence of the European online dispute resolution platform (ODR), accessible at the following address: https://entreprendre.service-public.fr/vosdroits/R48100
